2. Nature of the Service
Day Skipper Revision is an independent, self-study revision aid designed to supplement your preparation for the RYA Day Skipper theory syllabus. By using this Service you acknowledge and agree that:
- The Service is not affiliated with, endorsed by, or connected to the Royal Yachting Association (RYA) in any way.
- The Service is not a substitute for formal maritime training, practical instruction, or the official RYA Day Skipper theory course.
- The Service does not constitute professional maritime advice. Navigation at sea requires proper qualifications, practical experience, and up-to-date official publications.
- The content is for educational and revision purposes only.
3. No Guarantee of Exam Success
While the Service is designed to help you revise effectively, we make no guarantee or warranty that using the Service will result in you passing the RYA Day Skipper theory assessment or any other examination. Exam success depends on many factors beyond the scope of this tool.
4. Content Accuracy
We take reasonable care to ensure that the content provided is accurate and up to date. However, nautical regulations, standards, and best practices change over time. The Service may not reflect the very latest amendments to regulations such as the International Regulations for Preventing Collisions at Sea (COLREGs), IALA buoyage standards, or Admiralty publications.
You should always refer to official, current publications — including Admiralty charts and publications, the current edition of the RYA training materials, and Notices to Mariners — for definitive and up-to-date information. Do not rely solely on this Service for navigation or safety-critical decisions.
5. Payment and Access
The Service offers a free tier (limited modules) and a paid tier (full access to all modules, interactive tools, and mock exams).
- Full access is available for a one-time payment of £4.99 (or such other price as displayed at the time of purchase).
- There are no subscriptions, recurring charges, or auto-renewals.
- Payment is processed securely by Stripe. We do not store your payment card details.
- Access is granted to the email address used at checkout. You can restore access on additional devices using that email address.
6. Refund Policy
Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a right to cancel your purchase of digital content within 14 days. However, by making a purchase and immediately accessing the paid content, you consent to the supply of digital content beginning before the cancellation period expires and acknowledge that you will lose your right to cancel.
Notwithstanding the above, if you are not satisfied with the Service, you may contact us within 14 days of purchase at support@dayskippertheory.co.uk and we will process a full refund at our discretion.
7. Limitation of Liability
To the fullest extent permitted by law:
- The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Our total aggregate liability to you for any claim arising out of or in connection with the Service shall not exceed the amount you have paid for the Service (£4.99 or such amount as was actually paid).
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, however caused.
- We shall not be liable for any loss or damage arising from your reliance on content provided by the Service for navigation, safety, or any maritime activity.
Nothing in these terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any matter for which it would be unlawful to exclude or limit liability.
8. Intellectual Property
All content, design, code, graphics, and interactive tools on the Service are owned by Richard Moore or used under licence. You are granted a personal, non-exclusive, non-transferable licence to access and use the Service for your own private study. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Service without prior written consent.
9. Acceptable Use
You agree not to:
- Share, resell, or redistribute your access to the Service.
- Attempt to circumvent any access controls or payment mechanisms.
- Use automated tools to scrape, copy, or extract content from the Service.
- Use the Service in any way that could damage, disable, or impair it.
We reserve the right to terminate or suspend access to the Service at our discretion if we reasonably believe you have breached these terms.
10. Third-Party Services
The Service uses third-party services for payment processing (Stripe) and hosting (Vercel). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, security, or practices of third-party services.
11. Changes to These Terms
We may update these terms from time to time. The "last updated" date at the top of this page will be revised accordingly. Continued use of the Service after changes constitutes acceptance of the updated terms. If we make material changes, we will make reasonable efforts to notify users.
12. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
